I just went to court in NJ for 86 in a 65 zone, 4 pts. My only prior offense was 6 yrs ago, 35 in a 25, and I used the “usafe operation” 0 pt deal. This time, the prosecutor also offered the “unsafe” deal but advised I take a 79 in a 65 with 2 pts, since I currently have 0 pts. I took the 2 pt deal since the pts clear in 1 yr, and my insurance has a 2 or 3 pt grace. The prosecutor told me if I took the “unsafe” 0 pt deal, it would be #2 for me and the 5 yr clock would start ticking, which means if I “need” it a 3rd time within 5 yrs, it would be mandatory 4pts by law. Didn’t make much sense to “waste” it now.

My question is this: Is it typical for the judge to accept the plea bargain, impose the fines, and also add 3 days of community service? The judge said something at the begin about community service for those with tickets for 20+ over the limit. I had not heard of this in the past, and my prior offense 6 years ago is the only thing on my record. Any thoughts?
